Terms and Conditions
As a condition of using our websites and services, you agree to comply with and be subject to the following terms and conditions. Please read them carefully before making a purchase or booking.
Part A — General terms
These terms apply to all interactions with Amato's Liquor Mart, including our event ticketing website, our online store at amatos.com.au, and in-store purchases.
1. Acceptance of terms
As a condition of using our websites and services, you agree to comply with and be subject to the following terms and conditions. These terms apply to your use of:
- our event ticketing website;
- our online store at amatos.com.au; and
- any in-store purchases or interactions.
If you do not agree with any part of these terms, you must not use our websites or services.
2. Age verification and liquor licensing
You must be 18 years of age or older to purchase alcohol from us or to attend any event at which alcohol is served. This is a requirement under the Liquor Act 2007 (NSW) and applicable state and territory liquor laws.
By placing an order or purchasing a ticket, you confirm that you are at least 18 years of age. Orders will not be processed without age confirmation.
Amato's Liquor Mart holds a packaged liquor licence and an on-premises/catering licence under the Liquor Act 2007 (NSW). We comply with all statutory conditions applicable to those licence types, including the Responsible Service of Alcohol obligations set out in Section 9.
These terms are subject to the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law). Nothing in these terms excludes, restricts, or modifies the consumer guarantee provisions of the Australian Consumer Law. See Section 7 for details.
3. Personal information and in-store collection
We collect personal information in accordance with our Privacy Policy. That policy applies equally to information collected online, in-store, and at events.
In-store and event collection
We may collect personal information in-store and at events through sign-up forms (paper, tablet, QR code, or verbally via staff). There are two separate opt-ins available to you:
- Mailing list — to receive event invitations, newsletters, and promotions.
- Amato's Rewards membership — our loyalty program, subject to the additional terms in Part D.
You can opt into one without the other. We will only add you to our mailing list with your explicit consent.
If you join Amato's Rewards, we collect additional personal information as described in Part D. In-store collection is subject to the same Privacy Policy as online collection.
4. Pricing and payment
All prices displayed on our websites and in-store are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.
Online payments are processed securely by Stripe. Your card details are collected by Stripe directly and are never stored on our systems. For more information, see our Privacy Policy.
Pricing errors
While we take reasonable care to ensure our product descriptions and prices are accurate, errors may occasionally occur. If we discover an error in the description or price of a product or service you have ordered, we will contact you as soon as practicable so you can decide whether to proceed with your order at the correct price or receive a full refund.
5. Website content
We may update, modify, or remove content on our websites at any time without notice. While we endeavour to keep our websites accurate and up to date, we do not guarantee that all information is current, complete, or free from error at all times.
6. Changes to terms
We may update these terms and conditions from time to time. When we make changes, we will publish the updated terms on our website and update the "Last Updated" date at the top of this page. Where practicable, we will provide advance notice of material changes.
Your continued use of our websites or services after the notice period constitutes acceptance of the updated terms. We encourage you to review these terms periodically.
Electronic transactions
These terms, your order, and our confirmation constitute an electronic transaction within the meaning of the Electronic Transactions Act 1999 (Cth). By placing an order, you consent to transact electronically and to receive records (including receipts, confirmations, and notices) by email.
7. Australian Consumer Law guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Nothing in these terms purports to modify or exclude the conditions, warranties, and undertakings implied by the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law), and the equivalent state and territory legislation.
8. Limitation of liability
Without excluding, restricting or modifying the rights and remedies to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law or our liabilities under those provisions:
- Our websites and their content are provided on an "as is" basis. We make no warranty that the websites will be suitable for your particular purpose.
- To the maximum extent permitted by law, we exclude all other implied terms, representations, and warranties, whether statutory or otherwise, relating to the subject matter of these terms.
- We are not liable for any indirect, incidental, special, or consequential loss or damage arising from or in connection with your use of our websites or services, except to the extent that such loss or damage results from our negligence or wilful misconduct.
- Risk in goods passes to you upon delivery in accordance with the delivery instructions you provide.
- Our liability is reduced to the extent that your acts or omissions cause or contribute to the loss or damage.
9. Responsible Service of Alcohol (RSA) commitment
Amato's Liquor Mart is committed to the responsible service of alcohol. We comply with all applicable RSA requirements under the Liquor Act 2007 (NSW) and equivalent state and territory legislation.
Intoxication
We will refuse service or delivery to any person we reasonably believe to be intoxicated. This applies to in-store purchases, event attendance, and delivery of online orders.
Secondary supply
We will refuse service if we reasonably believe alcohol is being purchased on behalf of a minor. It is against the law to supply alcohol to a minor on licensed premises.
School uniform policy
We will not sell alcohol to any person wearing a school uniform, even if that person is 18 years of age or older.
Minors and identification
We take RSA very seriously and want to make sure we only sell alcohol to people of legal drinking age (18+). If you appear to be under the age of 25, we will ask you to present valid photographic identification before completing a sale. Acceptable forms of ID include a current Australian driver licence, passport, or proof-of-age card.
10. Liquor licensing acts
The sale and supply of alcohol in Australia is regulated by state and territory legislation. The following statutory warnings apply:
New South Wales
Under the Liquor Act 2007, it is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
For sales made in New South Wales, the sale of liquor is made at our licensed premises.
Your offer to purchase is subject to acceptance by the holder of the liquor licence, certification and evidence of you being over 18 years of age, the availability of stock, and the liquor being ascertained at the licensed premises.
Victoria
Under the Liquor Control Reform Act 1998 it is an offence to supply alcohol to a person under the age of 18 years (penalty exceeds $19,000). It is also an offence for a person under 18 to purchase or receive liquor (penalty exceeds $800).
Queensland
Under the Liquor Act 1992, it is an offence to supply liquor to a person under the age of 18 years.
South Australia
Under the Liquor Licensing Act 1997, Section 113: Liquor must NOT be supplied to persons under the age of 18 years.
Western Australia
Under the Liquor Control Act 1988, it is an offence to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises.
Tasmania
Under the Liquor Licensing Act 1990, it is an offence for liquor to be delivered to a person under the age of 18 years (fine not exceeding 20 penalty units). It is also an offence for a person under 18 to purchase liquor (fine not exceeding 10 penalty units).
Australian Capital Territory
Under the Liquor Act 2010, a person must not sell or supply liquor to a person under the age of 18 years on premises where the sale is authorised or in a public place. Maximum penalty: $5,500.
Northern Territory
Under the Liquor Act 2019, it is an offence to sell, supply, or serve alcohol to a person under the age of 18 years.
11. Copyright and legal entity
Legal entity
These terms and conditions are entered into with Amato's Liquor Mart (trading name).
Copyright
All website material, including design, text, graphics, and page layout, is owned by or licensed to Amato's Liquor Mart and is protected under Australian copyright law. You may view and save pages in the normal course of browsing, but you must not otherwise reproduce, transmit, adapt, distribute, sell, modify, or publish any material from our websites without our prior written consent.
Certain images and typefaces used on our websites are sourced under third-party licences (including the Unsplash Licence and SIL Open Font Licence) and remain the property of their respective owners.
Trademarks
The Amato's Liquor Mart name, logo, and Amato's Rewards are trading names of Amato's Liquor Mart.
12. Disclaimer
Although every effort is made to ensure the accuracy of information on our websites, all content is subject to change without notice. Amato's Liquor Mart makes no representations or warranties, express or implied, as to the accuracy, completeness, or suitability for any particular purpose of any information on our websites, or that the websites are free from viruses or other harmful components.
Use of any information obtained from our websites is at the visitor's sole risk. All promotional deals and offers are subject to availability and their own specific terms and conditions.
13. Content use agreement
From time to time, we may seek permission to repost or reproduce content you have shared on social media (for example, photographs or reviews). By granting permission — whether by replying with a designated hashtag, providing written consent, or other means — you:
- represent and warrant that you are the owner of the content or have the necessary rights and permissions to grant this licence;
- grant Amato's Liquor Mart a non-exclusive, irrevocable, royalty-free, worldwide right to reproduce, modify, adapt, publish, and display the content in any form and through any media for commercial and promotional purposes;
- acknowledge that we will use commercially reasonable efforts to credit the original creator and, where practical, link back to your social media account, but that credit is not mandatory;
- waive any right to inspect or approve the finished work incorporating your content; and
- waive any claim to royalties or other compensation arising from our use of the content.
If any provision of this content use agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14. Third-party links
Our websites may contain links to websites operated by third parties. These links are provided for your convenience only. We are not responsible for the content, accuracy, or privacy practices of any third-party website, and a link does not imply our endorsement of that website or its operator.
15. User accounts
If you register an account on our websites, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
We may suspend or terminate your account at our discretion if we reasonably believe you have breached these terms or engaged in fraudulent or suspicious activity.
Guest checkout is also available for purchases without creating an account. If you are an Amato's Rewards member, your membership account is subject to the additional terms set out in Part D.
16. Fraud and risk assessment
We maintain processes to detect potentially illegal, fraudulent, or non-compliant transactions. We may contact you by phone or email to confirm payment details and verify your identity or order information.
If we are unable to confirm the details of your order to our reasonable satisfaction, we reserve the right to decline or cancel the order and issue a refund.

17. Indemnity
You agree to indemnify and hold harmless Amato's Liquor Mart, its officers, employees, and agents from and against any loss, damage, cost, or expense (including reasonable legal fees) arising from or in connection with:
- your breach of these terms and conditions;
- the provision of false or misleading information (including false age verification); or
- your misuse of our websites or services.
18. Dispute resolution

If the matter cannot be resolved informally, you may lodge a formal written complaint with us. We will acknowledge your complaint and work to resolve it in a timely manner.
If the dispute remains unresolved after following the above steps, either party may refer the matter to the courts of New South Wales.
19. Severability
If any clause or part of a clause of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, it shall to that extent alone be deemed omitted, and the remaining terms shall continue in full force and effect.
20. Entire agreement
These terms and conditions, together with our Privacy Policy and any applicable Amato's Rewards program terms (Part D), constitute the entire agreement between you and Amato's Liquor Mart in relation to your use of our websites and services. They supersede all prior representations, agreements, and understandings, whether written or oral.
21. Governing law
These terms and conditions are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising from or in connection with these terms.
Part B — Online store (amatos.com.au)
The following additional terms apply when you place an order through our online store at amatos.com.au. These terms are to be read together with the general terms in Part A.
22. Placing an order
When you place an order through our online store, you confirm that all information you provide — including your name, delivery address, contact details, and payment information — is true, accurate, and complete.
By placing an order, you agree to receive electronic communications relating to your order, including order confirmations, dispatch notices, delivery updates, payment reminders, and cancellation notifications. These communications are transactional in nature and are separate from any marketing communications.
We are not obliged to accept any order. We may decline an order for any reason, including (without limitation) product availability, pricing errors, suspected fraud, or failure to meet delivery pre-conditions.
An order is not accepted until we send you an order confirmation by email. Until that time, your order constitutes an offer to purchase only.
23. Product descriptions
We make every effort to ensure that product images, descriptions, and specifications displayed on our website are as accurate as possible. However, actual products may vary in vintage, packaging, label design, or regional availability.
Wine vintages shown on the website are indicative only. Where a listed vintage is unavailable, we may supply the current or most recent available vintage unless you advise us otherwise.
Colours and general appearance of products may also vary due to your screen settings, display resolution, and browser configuration. These variations do not constitute a defect.
24. Retail limits
We reserve the right to set retail purchase limits per customer, per product category, or per order. These limits may change at any time without prior notice.
Orders that exceed applicable limits may be partially cancelled and refunded at our discretion. We will notify you if any items are removed from your order due to retail limits.
We may also impose temporary purchase limits on certain products from time to time, including limited-release or allocated products.
25. Delivery and delivery fees
In these terms, "deliver" and "delivery" include collection under any pick-up option from our nominated location.
We deliver across Australia, subject to the delivery pre-conditions and restricted area provisions set out in Section 26 and Section 34.
Delivery fees are calculated at checkout and displayed before you confirm your order. The applicable fee depends on your delivery address, order weight, and the delivery method you select.
26. Delivery address and pre-conditions
You agree that the delivery address is the address you provided at checkout, or any other address we subsequently agree in writing to accept. We will not process a delivery unless all requested delivery details have been provided in full.
It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
Authority to accept delivery
We may reasonably rely on any person present at the delivery address who takes receipt of the order as being authorised to accept delivery on your behalf.
Delivery refusal
We will not complete delivery if the likely recipient appears to be:
- under the influence of alcohol or drugs;
- under the age of 18 years; or
- acting on behalf of a person who is intoxicated or under 18.
Age verification on delivery
Upon delivery, the recipient may be required to present valid photo identification for the purpose of age verification. Their name, date of birth, and identification type may be recorded in accordance with our Privacy Policy and applicable liquor licensing requirements.
No purchase for resale
Products purchased through our online store are for personal consumption only and must not be purchased for the purpose of resale. We may contact you if we have reasonable concerns about the quantity or frequency of your orders.
Restricted areas
We comply with all applicable Commonwealth, state, and territory liquor laws and may decline or cancel delivery to areas where legislation restricts online alcohol delivery, including dry communities and restricted areas. If your delivery address is in a restricted area, we will contact you and offer a refund. See also Section 34 for Northern Territory-specific provisions.
27. Delivery times
We will endeavour to deliver your order within the timeframe nominated and paid for at the time of your order. Estimated delivery times are provided in good faith but are not guaranteed.
You accept that, occasionally, due to circumstances outside our reasonable control — including carrier delays, severe weather, public holidays, or high-demand periods — deliveries may be delayed. We will make reasonable efforts to notify you of any significant delay.
28. Failed delivery and non-collection
Failed delivery
If delivery fails for any reason, we will return the products to our store or depot and contact you by email or phone. You may arrange another delivery attempt by contacting us.
If we do not hear from you within 5 business days of our notification, we reserve the right to cancel your order and issue a refund.
We may also return products and issue a refund where delivery has failed due to circumstances beyond our control, including an incomplete or incorrect address, inability to access the delivery location, or failure to meet the delivery pre-conditions set out in Section 26.
Non-collection of pick-up orders
For pick-up orders not collected within 7 days of the nominated collection date, we reserve the right to cancel the order and issue a refund.

29. Cancellations by us
We may cancel your order, in whole or in part, before completion of delivery — even if we have received payment or sent a tax invoice. We will give you reasonable notice by phone or email.
Circumstances in which we may cancel include (without limitation):
- a product is unavailable or out of stock;
- your order is in breach of these terms or the law;
- delivery pre-conditions cannot be met (in this case, any delivery fee already incurred may be deducted from your refund); or
- circumstances beyond our reasonable control prevent fulfilment.
If we identify a pricing or description error after you have placed an order, we will contact you so you can decide whether to proceed at the correct price or receive a full refund.
Where we cancel an order, we will process a refund to your original payment method within a reasonable timeframe.
30. Cancellations by you
You cannot make changes to an order after it has been placed. If you wish to amend your order, you must cancel the existing order and place a new one.

31. Returns and refunds
Change-of-mind returns
We do not accept change-of-mind returns on alcohol products. This is standard practice for licensed liquor retailers in New South Wales and across Australia.
Australian Consumer Law guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If a product is faulty, not as described, or unfit for its intended purpose, you are entitled to a remedy.
Depending on the nature of the failure:

32. Delivery records
We may record details relating to deliveries. Records may include age verification details and a photograph of the completed delivery.
We will only use and disclose such records for reasonable purposes, including:
- proof of delivery;
- order administration and dispute resolution; and
- complying with record-keeping requirements under applicable liquor licensing laws.
All personal information collected as part of delivery records is handled in accordance with our Privacy Policy.
33. Risk and title
Risk of loss or damage to products passes to you upon delivery, including delivery to unattended locations where you have provided specific delivery instructions authorising such placement.
Title to products and the place of supply occurs at the point where we dispatch the products from our licensed premises. We do not supply alcohol from premises that are not licensed under the applicable liquor legislation.
On refund, title to the relevant products passes back to us.
34. Northern Territory and restricted area orders
If you are a Northern Territory resident or are ordering for delivery to the Northern Territory, the listing of a product on our website does not constitute an offer to sell that product to you.
Additional price checks may be completed before your order is confirmed. The final price may be adjusted to ensure compliance with minimum unit price requirements under the Liquor Act 2019 (NT). If the price increases, we will contact you before processing the order.
We may not deliver to postcodes or communities where liquor restrictions apply under applicable state or territory law. If your delivery address falls within a restricted area, we will contact you and offer a full refund.
35. Promotions and voucher codes
Voucher codes
Promotional voucher codes are subject to the following conditions. A voucher code:
- cannot be exchanged for cash;
- cannot be used in conjunction with another voucher code;
- cannot be re-used on a subsequent transaction; and
- cannot be partially redeemed across multiple orders.
Promotions
We may from time to time offer promotions, which will be subject to their own terms and conditions published at the time of the offer. Promotions may be withdrawn or varied at any time without prior notice, unless otherwise stated in the promotional terms.
36. Gift cards
Gift cards are valid for a minimum of 3 years from the date of purchase, as required by the Treasury Laws Amendment (Gift Cards) Act 2018 (Cth).
No post-purchase fees apply to gift cards.
Gift cards:
- are not redeemable for cash;
- cannot be used to purchase other gift cards; and
- will not be replaced if lost, stolen, or damaged, unless required by law.

Part C — Event bookings
The following additional terms apply when you book tickets to an event hosted or organised by Amato's Liquor Mart (including wine dinners, tastings, and masterclasses). These terms are to be read together with the general terms in Part A.
37. Making an event booking
A booking is confirmed when payment is successfully processed through our payment provider. Each ticket is issued for one named guest.
A booking confirmation will be sent to the email address you provide at checkout. It is your responsibility to ensure the email address is correct. If you do not receive a confirmation within a reasonable time, please contact us at amatos@amatos.com.au.
We reserve the right to refuse or cancel any booking at our discretion, including where we reasonably believe a booking has been made in breach of these terms, in connection with fraudulent activity, or where age verification requirements cannot be met.
Where a booking is placed with a deferred payment method (such as direct deposit or bank transfer), the booking is provisionally held but is not confirmed until full payment is received and verified by us. A booking confirmation email will be sent once payment is verified.
Payment reminders
If payment has not been received for a provisionally held booking, we will send you a payment reminder by email to the address provided at checkout. This reminder is an automated, transactional communication and is separate from any marketing communications.
If we do not receive full payment within 24 hours of the reminder email being sent, we reserve the right to cancel your booking so that the places can be offered to other customers. You will be notified of any cancellation by email.
By placing a booking, you agree to receive these transactional communications, including booking confirmations, payment reminders, and cancellation notifications.
Card processing surcharge
A card processing surcharge applies to payments made by credit or debit card via Stripe. The surcharge covers the cost of card acceptance and is calculated as a percentage of the order total plus a fixed component. The exact amount is displayed before you confirm your order. No surcharge applies to direct deposit payments.
Event details — including date, time, venue, menu, and featured products — are as described at the time of booking. We may make minor changes to event details (for example, substitution of a wine due to supplier availability) without prior notice, provided the overall nature of the event is not materially altered.
38. Group bookings and guest information
If you make a booking on behalf of other guests, you warrant that:
- all guest details provided are accurate and complete;
- all guests in your booking are aged 18 years or over; and
- you have authority to make the booking and accept these terms on their behalf.
You are responsible for communicating event details — including any changes notified by us — to all guests in your booking.
You acknowledge that, where it is impracticable for us to collect personal information directly from each guest in a group booking, your provision of their details on their behalf is permitted under APP 3.6 of the Privacy Act 1988 (Cth). You should inform the relevant guests that you have provided their information to us and direct them to our Privacy Policy.
39. Event cancellation and refunds
Option A — Strict (no-refund policy)
No refunds are available once a booking is confirmed.
Tickets are transferable to another person. Name changes can be made up to 48 hours before the event by contacting us at amatos@amatos.com.au or (02) 9560 7628.
Option B — Moderate (7-day refund window)
Full refund if you cancel 7 or more days before the event date.
Within 7 days of the event, no refund is available. However, tickets are transferable to another person. Name changes can be made up to 48 hours before the event by contacting us at amatos@amatos.com.au or (02) 9560 7628.
Option C — Generous (tiered refund policy)
Full refund if you cancel 14 or more days before the event date.
50% refund if you cancel between 7 and 14 days before the event date.
Within 7 days of the event, no refund is available. However, tickets are transferable to another person. Name changes can be made up to 48 hours before the event by contacting us at amatos@amatos.com.au or (02) 9560 7628.
Cancellation due to non-payment
Where a booking has been placed with a deferred payment method and full payment is not received by the deadline stated in our payment reminder email, we may cancel the booking. A cancellation notification will be sent to the email address provided at checkout. No refund is payable because no payment was received.
If you believe your booking was cancelled in error, or if you have already made payment, please contact us immediately at amatos@amatos.com.au or (02) 9560 7628.
All options — refund processing
Where a refund is payable, it will be processed to the original payment method within a reasonable timeframe.
If a card processing surcharge was applied to your payment, it will be refunded in full for a full refund, or proportionally for a partial refund, in accordance with card network rules.

40. Event changes or cancellation by us
Material changes
If we make a material change to an event — including a change of date, venue, or menu — we will notify you as soon as practicable and offer you the option of a full refund.
Event cancellation
If we cancel an event entirely, you are entitled to a full refund. Refunds will be processed to the original payment method within a reasonable timeframe.
Force majeure
We are not liable for failure to hold an event due to circumstances beyond our reasonable control, including but not limited to:
- severe weather events;
- venue unavailability;
- government restrictions or public health orders;
- utility failures; and
- supplier failure.
In such circumstances, we will offer you the choice of a full refund or a credit towards a future event of equivalent value.
41. Dietary requirements and allergen disclaimer
We will make reasonable efforts to accommodate dietary preferences submitted at the time of booking.
Our events are held in shared dining environments. We cannot guarantee an allergen-free setting. Meals may be prepared in kitchens that handle nuts, gluten, dairy, shellfish, and other common allergens.

We accept no liability for allergic reactions where we have made reasonable efforts to accommodate your stated dietary requirements.
42. Event conduct and responsible service of alcohol
All events are conducted in accordance with our obligations under the Liquor Act 2007 (NSW) and the statutory conditions of our on-premises/catering licence. In accordance with our RSA commitment (see Section 9):
- We reserve the right to refuse alcohol service to any person who appears intoxicated.
- We reserve the right to refuse service where we believe alcohol may be supplied to a minor.
- We reserve the right to remove any attendee who behaves in a manner that is disruptive, unsafe, or in breach of our RSA obligations.
No refund will be provided where service is refused or an attendee is removed under these circumstances.
By attending one of our events, you acknowledge and agree to comply with all directions given by our staff in relation to the responsible service of alcohol.
43. Promotional draws
From time to time, we may offer promotional draws or competitions in connection with event bookings. Each promotional draw will be subject to its own specific terms and conditions, which will be published on our website before the draw opens.
Entry into any promotional draw constitutes acceptance of the applicable promotion-specific terms. All promotional draws are conducted by Amato's Liquor Mart and governed by the laws of New South Wales, including the Community Gaming Act 2018 (NSW) and the Australian Consumer Law.
Current promotions
Part D — Amato's Rewards program
The following additional terms apply to the Amato's Rewards loyalty program. These terms are to be read together with the general terms in Part A. By joining or participating in the program, you agree to these terms.
44. Program overview and eligibility
Amato's Rewards is a loyalty program operated by Amato's Liquor Mart for eligible customers.
Eligibility
- You must be 18 years of age or older.
- You must be an Australian resident.
- One membership per person.
How to join
- In-store — via paper form, tablet, QR code, or verbally through our staff.
- Online — at amatos.com.au.
Important: Joining Amato's Rewards is separate from subscribing to our mailing list. You can be a rewards member without receiving marketing emails, and you can be on our mailing list without being a rewards member. Each requires its own consent.
45. Membership information
To join Amato's Rewards, you must provide the following information:
- name;
- email address;
- date of birth; and
- contact details (phone number and/or postal address).
Your date of birth is collected solely for the purpose of providing you with birthday specials (see Section 49).
We also collect your purchase history and product preferences to personalise your rewards experience, tailor member-only offers, and improve the program.
Our Privacy Policy explains how we collect, use, store, and protect your personal information.
46. Earning points
Points are earned on eligible purchases made in-store and at amatos.com.au.
Eligible purchases
Eligible purchases include alcohol, packaged food, and related products sold by Amato's Liquor Mart. The following items do not earn points:
- gift cards;
- delivery fees; and
- event tickets (unless expressly stated in the event promotional terms).
When points are credited
Points are credited to your account after the transaction is completed and any applicable return or refund period has passed.
If a purchase is subsequently refunded, the corresponding points will be deducted from your balance. If this results in a negative balance, the deficit will be offset against future point earnings.
47. Redeeming points
Points can be redeemed on future purchases in-store or online.
Redemption conditions
- Points cannot be exchanged for cash.
- Points are not transferable between members.
- Points cannot be used to purchase gift cards.
- Redemption is subject to the product being available at the time of purchase.
- Partial point redemption is permitted, subject to the minimum threshold.
48. Points expiry
Option A — No expiry
Points do not expire, provided your Amato's Rewards account remains active. If your account is closed or terminated, any unredeemed points will be forfeited in accordance with Section 52 and Section 53.
Option B — 12-month rolling expiry
Points expire 12 months after the date they were earned. Expired points are automatically removed from your balance.
Option C — Inactivity-based expiry
Points expire if your account is inactive for 24 consecutive months. Account activity includes any eligible purchase, point redemption, or account login. Once activity resumes, the expiry clock resets.
We will notify you before points expire, where practicable, by email to the address registered on your account.
49. Birthday specials
Members receive a birthday offer each year.
Conditions
- One birthday offer per member per year.
- You must have a valid date of birth recorded in your account to receive the offer.
- Birthday offers cannot be exchanged for cash.
- Birthday offers may not be combined with other promotions unless expressly stated otherwise.
50. Member-only promotions and offers
We may offer members exclusive pricing, early access to events or products, or bonus point promotions from time to time.
These offers are subject to their own terms at the time of the offer and may be limited by:
- stock availability;
- store location; or
- membership status or tenure.
We reserve the right to withdraw or modify any promotion at any time without prior notice.
51. Rewards communications
We may send you rewards-related communications, including:
- points balance updates;
- birthday offers;
- member-exclusive promotions; and
- program updates and changes.
Opting out
You can opt out of promotional rewards communications at any time by:
- using the unsubscribe link in any rewards email; or
- contacting us at amatos@amatos.com.au.
Transactional rewards notifications — such as points earned, points redeemed, and points expiry reminders — may still be sent even if you opt out of promotional messages.
Important: Rewards communications are separate from our general mailing list. Opting out of rewards promotions does not unsubscribe you from the general mailing list, and vice versa. See our Privacy Policy for full details on direct marketing and your communication preferences.
52. Account management
You are responsible for keeping your membership information accurate and up to date. You can update your details:
- online at amatos.com.au; or
- in-store by speaking with our staff.
You may close your Amato's Rewards account at any time by emailing us at amatos@amatos.com.au. Any unredeemed points will be forfeited upon voluntary account closure. We recommend redeeming your points before requesting closure.
53. Suspension and termination
We may suspend or terminate your Amato's Rewards membership if we reasonably believe you have:
- breached these terms;
- engaged in fraudulent activity; or
- abused the program (including, without limitation, manufactured transactions to earn points, misuse of promotional offers, or creation of multiple accounts).
Your points balance is forfeited upon termination for cause.
We will give you reasonable notice before termination where practicable and provide you with an opportunity to respond. Notice will be sent to the email address registered on your account.
54. Changes to the program
We may modify, suspend, or discontinue the Amato's Rewards program, or any aspect of it, at any time.
We will give reasonable notice of material changes, including changes to:
- the earning rate;
- the redemption value;
- the points expiry policy; or
- eligible purchase categories.
If we discontinue the program, members will be given a reasonable wind-down period during which they may redeem outstanding points before they are forfeited.
55. Program liability
Points have no cash value and do not constitute property. Points do not represent a stored monetary value and cannot be assigned, traded, or bequeathed.
We are not liable for loss of points due to system errors, except where required by the Australian Consumer Law.
The Amato's Rewards program does not create any employment, agency, partnership, joint venture, or fiduciary relationship between Amato's Liquor Mart and its members.
Our total liability in connection with the program is limited to the value of points lost or not credited, calculated at the applicable redemption rate at the time the loss occurred. This limitation does not apply to rights that cannot be excluded under the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law).
